Is Sports Betting Legal in Virginia?

Sports betting in Virginia is legal both online and in person. The Virginia General Assembly accepted Governor Ralph Northam’s amendments to HB896/SB384, and sports betting went live in January 2021. While there are about 16 active sportsbooks in the Old Dominion, only three locations are available for retail wagering as of March 2024.

Currently, punters can’t place bets on Virginia college sports. In addition, all in-game betting on college sports is prohibited. Sports bettors, however, have access to a wide range of markets, which will advertise all the latest odds for many sports, including NBA, NHL, NFL, MLB, and soccer.

As mentioned earlier, in-person sports betting is also legal in Virginia, but options are limited. The Rivers Casino in Portsmouth opened in January 2023. Meanwhile, the Hard Rock Hotel & Casino in Bristol and Caesars Casino in Danville have temporary locations and are currently constructing permanent sites.

The Headwaters Casino in Norfolk, yet to be launched, is expected to open a temporary location soon.

You can wager at any of the 16 VA-licensed sportsbooks or place bets at a land-based betting site. However, if you want access to a wider selection of betting markets, Virginia college sports bet options, college props, and bigger bonuses, you should sign up to one of our top 10 recommended offshore sportsbooks.

Online Sportsbooks

Surprisingly, online betting in Virginia was given the nod ahead of retail betting. There are currently 16 licensed sportsbooks in the Old Dominion, and each sports betting operator has their own betting apps. Some VA betting apps include:

  • FanDuel Sportsbook
  • DraftKings Sportsbook
  • BetMGM Sportsbook
  • Caesars Sportsbook
  • BetRivers Sportsbook
  • Hard Rock Bet
  • Unibet Sportsbook
  • Betway Sportsbook

Virginia’s gambling laws make provision for 18 online sportsbooks only, so only 2 slots are left. We expect that both slots will be filled sooner rather than later.

In the Old Dominion, you have to be at least 21 years old to bet online, and the Virginia Lottery sports betting department monitors all gambling activities. Virginia has a relatively competitive system compared to other markets, such as Washington DC, which has a virtual lottery monopoly.

Land-based betting in Virginia

Unlike some of its neighboring states, VA had almost no gambling locations before sports betting in Virginia was approved.

At the moment, there are 3 land-based sportsbooks offering sports betting, with 2 of them currently working on a more permanent location. Meanwhile, there’s a fourth sportsbook expected to open in Norfolk soon but a sportsbook partner has not yet been announced.

  • Hard Rock Bristol Resort and Casino (Permanent location scheduled to open in 2024)
  • Norfolk Headwaters Casino –  (Still in the works)
  • Caesars Casino in Danville (Permanent location scheduled to open in 2024)
  • Rivers Casino in Portsmouth (Opened January 2023)

Horse Racing & Off-Track Betting

Even though horse racing was historically a popular sport in the US, Virginia was one of the last states to legalize wagering on races. As a result, it currently has just one licensed thoroughbred racetrack, which is called Colonial Downs, and one harness racing track at Shenandoah Downs. The two tracks offer pari-mutuel wagering on horse races.

Today, you can bet on four licensed OTB (Off-Track Betting) sites across VA:

  • Breakers Sports Grille, Henrico County
  • Ponies & Pints, Richmond
  • Buckets Bar & Grill, Chesapeake
  • The Windmill OTB Sports Grill, Collinsville

With a shortage of OTB locations, most Virginia betting is carried out online at online sites, such as TwinSpires or TVG, which accepts ADWs (Advance-Deposit Wagers).

Sports Betting Guides by State

Virginia Sports Betting Legislation Timeline

Just like many other US states, there were plenty of roadblocks, delays, and opposition before Virginia sports betting was given the green light. Let’s chart some of the key moments that helped bring about legal sports betting in Virginia:

  • 14 May 2018 – The Murphy v. NCAA decision by the Supreme Court established state autonomy in terms of sportsbook gambling legality, free from federal intervention.
  • June 2018: Virginia legalize horse racing machines, which are digital machines used to wager on prestigious races.
  • April 2019: Colonial Downs, Virginia’s only thoroughbred horse racing track, begins holding live races again after a 6-year closure.
  • March 2020: The Virginia legislature votes to allow casinos to be built in 5 cities that fulfilled criteria relating to poverty and population loss. All eligible cities are required to hold a referendum before moving forward with opening the casinos.
  • April 2020: The VA legislature legalizes Virginia online sports betting after Gov Ralph Northam signed SB 384 into law.
  • November 2020: Voters in Norfolk, Bristol, Danville, and Portsmouth give their consent for casinos to open in these cities in four separate referendums. Casinos are expected to open in 2023.
  • January 2021: Legal sports betting in Virginia goes live, with FanDuel, DraftKings, BetMGM, and BetRivers opened up to VA bettors.
  • November 2021: Voters in Richmond are allowed to decide whether Virginia should open up a fifth casino. They vote not to allow a casino inside the city.
  • 2023: The issue regarding opening a casino in Richmond was put back on the November 2023 ballot.

Offshore Online Sports Betting in Virginia

Offshore sites offering sports betting in Virginia are a great alternative to the state-licensed sportsbooks in Virginia. Offshore sportsbooks will usually be based in a foreign country, such as Panama and Curacao.

On this page, we have listed the top 10 offshore sites, all of which are safe to play. These sites have established a reputation for providing fast payouts, as well as ensuring a high level of customer support for an overall seamless user experience.

Virginia Daily Fantasy Sports

Virginia became the first state in the country in 2016 to permit legalized wagering on DFS (Daily Fantasy Sports).

Bettors now have a choice of several platforms where to place wagers on DFS. This includes DraftKings and FanDuel.

Virginia Casino Laws

Until recent casino legislation passed, Virginia was one of the few states without a commercial or tribal casino. It is likely that when the casino laws are rubber-stamped, the state will be limited to having just land-based casinos.

Land Based Casinos

In 2019, Virginia’s legislators approved a law that will introduce a limited number of land-based casinos across the state. The plan is for 5 casinos to be built, but at the moment, only four have been approved. The fifth casino is expected to be built in Richmond when or if approved.

The four approved new casinos in Virginia will be built in Bristol, Danville, Norfolk, and Portsmouth. The Bristol Casino will be run by the Seminole Tribe, which also controls several Florida casinos.

Online Casinos

As things stand, there are no plans to introduce online casinos to Virginia. So, it will be impossible for an online casino operator to obtain a Virginia operating license.

Nevertheless, residents looking to get their fix can sign up to an offshore casino account. Here, you will find some of the best bonuses, as well as a wide range of games to tuck into.

Virginia Gambling Taxes

Tax rules in Virginia are the same as most other states across the US. All residents will have to pay a combination of federal and state taxes on any winnings. Federal taxes are capped at 24% on any winnings that pass a certain threshold.

Virginia online gambling taxes will normally vary between 2% and 5%, plus a potential fixed sum of up to $720. However, you can’t offset gambling losses against other income to reduce your taxes if you lose money while betting on sports.
