Is Sports Betting Legal in Arkansas?

For decades, a federal law held back states across America from allowing sports betting, Arkansas included. After the law – PASPA – was struck down in 2018, voters approved a constitutional amendment and Arkansas legalized sports betting in November of that year.

While this was a great step forward, sports betting still has a lot of room to develop in the state. Wagering is allowed only on the premises of a casino, currently including just 3 licensed facilities.

This means that online wagering at these casinos in Arkansas and Arkansas sports betting apps are still not available to state residents. You may be happy to hear, however, that many are anticipating this to change soon.

In 2021, House Bill 1942 was introduced by representative Lee Johnson. This would have allowed for The Arkansas Racing Commission to approve and regulate online sports betting.

Even though the bill died, it didn’t stop the efforts and a few months later there was yet another push to allow mobile sports betting. The Racing Commission is expected to vote on allowing this form of wagering by the end of 2021.

Arkansas sports betting apps are likely to be a thing by February of 2022, and for Arkansas online betting doesn’t seem to be far away from acquiring legal status.

Online Sportsbooks

Although land-based wagering has been available since 2019, online sports betting in Arkansas has yet to catch up.

Luckily, we’ve recently been seeing more of a legislative push to amend this. Many people, and even officials, expect a big change in Arkansas’ gambling scene to come in 2022.

While state residents still wait on Arkansas to launch its online sportsbooks, they can partake in online betting on many offshore sites.

Joining and wagering through such sites is perfectly legal, and can be a convenient and secure solution for those looking to place their bets on the web.

Land-based Betting in Arkansas

Following the 2018 Amendment 100 changes in sports betting regulations, Arkansans got to enjoy sports betting at brick-and-mortar casinos starting mid-2019.

The first sports bets in Arkansas after the repeal of the Professional and Amateur Sports Protection Act were placed in July 2019 at Oaklawn Racing Casino Resort. Southland Casino Racing accepted its first wagers sometime after, in January 2020. Since then, these two establishments have been transformed into full-fledged casinos.

The state decided to issue a total of four casino licenses. In 2019 The Arkansas Racing Commission voted to approve the issuing of a license to Jefferson county.

Currently, Arkansas sports betting is allowed at the following facilities:

  • Oaklawn Racing Casino Resort in Hot Springs National Park
  • Southland Casino in West Memphis
  • Saracen Casino Resort in Pine Bluff

The final license allows for a casino in Pope county, however, there is yet to be an operating establishment launched.

Land-based casinos saw $31 million placed in sports bets by the end of 2020. Even in the following year, sports betting was only a minor part of the casino profit, however, it is still a valuable offer that elevates the Arkansas casino experience.

Arkansas  Horse Racing & Off-Track Betting

While PASPA held back Arkansas sports betting laws, horse racing operated legally for years. Racebooks are even accessible to residents as young as 18.

Sports betting Arkansas sites are a great way to wager on your favorites off-track. Since online betting is yet to be legalized in the state, offshore sites are a great place for horse racing fans. A lot of sites even offer rebate bonuses on their racebooks!

Timeline of Arkansas Sports Betting Legislation

The Professional and Amateur Sports Protection Act kept the status of sports betting across the whole of the US stagnant since 1992. Following its repeal by the US Supreme Court in 2018, states were allowed to form their respective laws regarding sports betting.

Let’s have a peek at the timeline of Arkansas allowing sports betting, and what may be in store:

  • November 2018: Arkansas legalized sports betting after a vote on Amendment 100 to its state constitution. The law would take effect July 1st, 2019;
  • 9 July 2018: The first legal sports wagers were placed at Oaklawn Racetrack and Casino;
  • January 2021: Senator Will Bond introduces SB 669 that would permit online sports betting, but the bill does not go to a vote.
  • April 2021: Representative Lee Johnson proposes HB 1942 that would let the Arkansas Racing Committee regulate online sports wagering, however, the bill dies in the house committee. Arkansas mobile sports betting also fails to become legalized;
  • 2022: The answer to ‘Is online sports betting legal in Arkansas?’ might be changing very soon, as efforts are increasing to legalize electronic wagering in the state;

Offshore Betting

Arkansas sports betting on physical casino property has been legal for years, but online gambling in Arkansas is a whole other story.

Even though the striving for legalized and state-regulated online sportsbooks has grown stronger, as of today, Arkansas online sports betting is not permitted. This leaves state residents with fewer sports wagering options, but fewer can mean plentiful in this case.

Many offshore betting sites are more than happy to accept Arkansans’ sports wagers and offer betting odds on pretty much any sport you can imagine.

While it may seem risky, offshore sites have their licenses and regulations and can be perfectly safe for US citizens to use – it’s all about finding the right ones.

Legitimate offshore sites are a great way to conveniently place sports bets online, especially useful considering Arkansas has a limited number of locations where residents can physically wager.

Arkansas Daily Fantasy Sports?

With allowing sports betting, Arkansas also allows for fantasy sports betting. However, you’re unlikely to easily find the option to bet on daily fantasy sports in the operating casinos.

As online sports betting has yet to be legalized in the state, residents are left with one other option – offshore sites.

Even if you have an account with an offshore sportsbook, you may not find any fantasy sports betting odds available. This shouldn’t concern you too much though, as many other sites do offer such odds.

Bettors simply need to open an account with an offshore site that is, above all, secure, and can offer them the chance to wager on their preferred sport, even if it’s a fantasy one.

Arkansas Casino Laws

Any gambling activity that is not specifically allowed is considered illegal in the state.  The repeal of PASPA made way for new changes to Arkansas sports betting laws and growth in the gambling market.

However, even before 2018, Arkansas, while not the most liberal in terms of gambling, allowed for many gaming activities compared to other southern states.

Horse racing and dog racing have been regulated by the Arkansas Racing Commission for years, and require a minimum age of 18 to bet on.

Casinos, while not plentiful, do offer slots, table games, raffles, and bingo. Arkansas also has a state lottery, and we’re optimistic about its growing gambling market.

Online Casinos

Online casinos are not legal in the state of Arkansas. With both the establishments themselves and officials striving to see change, hopefully, it’s soon to happen.

Players are still free to place their wagers at three authorized casinos across the state, however many will find it much more practical to use an offshore online betting site.

Arkansas doesn’t take any actions against players joining offshore online casinos, yet it also does not oversee the operating casinos. This is why users should be careful when choosing their online sportsbooks, and make sure they are putting their money with a trustworthy and legitimate provider.

Land Based Casinos

Casino sports betting in Arkansas is currently legal but limited to only 4 licensed locations. What’s more, the final license has yet to be awarded to a built establishment.

This means that as of now, there are only 3 operational casinos, which serve as legal sports betting Arkansas locations.

Two of the three casinos are located on racetracks: Oaklawn Racing Casino Resort in Hot Springs National Park and Southland Casino in West Memphis. The Saracen Casino Resort in Pine Bluff is also licensed to accept sports bets.

Arkansas Gambling Tax

After legalizing sports betting, Arkansas cemented the governing rules in early 2019.

The Arkansas sports betting tax rate is 13% on the first $150 million. Anything over this amount is taxed at 20%.
