Is Sports Betting Legal in Indiana?

Back in May 2019, Indiana made the historic decision to legalise sports betting. And the Hoosier State wasted no time in getting things operational, either. Just four months after the decision was made, the first sportsbook was up and running. So if you’re at least 21 years of age, sports betting in IN is completely legal.

Online Sportsbooks

Indiana online sports betting is also allowed, but there are conditions attached for the operator. For an internet betting site to be legal, it must be affiliated with a bricks and mortar sportsbook that has a proper license. This has led to several bookmakers partnering with existing land-based casinos, for instance, to offer their services.

Land-based Betting in Indiana

Retail sports betting is available across the state at various locations, including the following sites:

  • Ameristar Casino Resort
  • Caesars Southern Indiana
  • FanDuel at Belterra
  • FanDuel at Blue Chip
  • French Lick Casino Resort
  • Hollywood Casino
  • Harrah’s Hoosier Park
  • Horseshoe Hammond Park
  • Indiana Grand
  • Rising Star Casino Resort
  • William Hill
  • Winner’s Circle Indianapolis
  • Winner’s Circle Clarksville
  • Winner’s Circle New Haven

Indiana Horse Racing & Off Track Betting

Wagering on horse racing is not classed as sports betting in Indiana, and was legalised long before the 2019 law came to pass. In fact, it’s been legal to bet on the sport of kings in Indiana since 1989.

There are two horse racing tracks located in IN. Hoosier Park opened its doors in 1994, while in 2002, Indiana Downs at Shelbyville followed suit. Both have since become what are known as “Racinos”, when they were granted permission to offer slot machines back in 2008 and 2009 respectively.

There are many off track betting locations distributed throughout the state too. Winner’s Circle, owned by Caesars Entertainment, operates a number of sports bars and racing betting facilities across Indiana.

Timeline of Indiana Sports Betting Legislation

Although Indiana sports betting legislation is a relatively recent thing, it is just a small part of a bigger gambling picture. Let’s take a look at the history of Indiana online gambling legislation.

  • 1851 – The Indiana Constitution mentions a ban on lotteries, which is interpreted as a blanket ban on all games of chance
  • 1988 – After 137 years, the lottery ban is finally lifted, leading to the creation of the Hoosier Lottery
  • 1992 – The US Congress passes the Professional and Amateur Sports Protection Act (PASPA) which prevents individual states from legalizing sports betting
  • 2016 – A Senate bill declares Daily Fantasy Sports to be games of skill, rather than chance
  • 2017 – Licenses to run DFS are awarded to four operators
  • 2018 – The PASPA is repealed, with the Supreme Court declaring that it conflicted with the Tenth Amendment
  • 14 May 2018 – The Murphy v. NCAA decision by the Supreme Court established state autonomy in terms of sportsbook gambling legality, free from federal intervention.
  • 2019 – On May 8, Indiana becomes the 14th US State to legalize sports betting
  • 2019 – Just four months later on September 1, the first sportsbook commences operations
  • 2019 – The first mobile sports betting app gets up and running the following month on October 3

Offshore Online Sports Betting in Indiana

The recent legislation around bookmakers in Indiana states that, for a sportsbook to be able to operate online, it must be affiliated with a land-based site. However, players can freely access many online betting sites which are based abroad and are not actively touting for business in the US. So how are these offshore betting companies handled locally?

At the moment, there is nothing written into Indiana state law that says it is illegal to bet with such sites. They fall into something of a grey area. We are not aware of any individual having ever been prosecuted for playing at international casinos or sports betting sites.

Indiana Daily Fantasy Sports

Mike Pence, then Governor of Indiana, pushed legislation through in 2016 which clarified Daily Fantasy Sports as a game of skill, rather than luck. As a result, there was no longer a reason for DFS to be banned. So just a year later, DraftKings and three other firms were given licenses to operate fantasy games.

Indiana Casino Laws

With the lifting of the state-wide lottery ban in 1988, the development of casino gaming legislation was inevitable. After several years of trying to push bills through the Senate, in 1993, a compromise was reached. Licenses were awarded for as many as 11 riverboat casinos.

In 2007, legislation was passed allowing the two racetracks to install slot machines. Then in 2015, the law was further amended to allow the riverboats to move into land-based premises, due to competition in nearby states. Finally, in January 2018, the state’s only Native American tribal casino opened its doors.

Online Casinos

At the time of writing, there is no law addressing the use of online casinos. Although land-based and riverboat gaming is legal, there is nothing explicitly legalizing internet casino sites.

However, much like with offshore online sportsbooks, there is a plethora of international casino brands accessible to players online. These exist within a legal grey area and no Indiana residents are known to have been punished for playing at such sites.

Land Based Casinos

Until fairly recently, there were no land-based Indiana casinos permitted. The law only allowed for riverboat casinos until 2007. Here is a full list of the various casinos found across IN.

  • Bally’s Evansville (Evansville, Land-based)
  • Caesars Southern Indiana (Elizabeth , Land-based)
  • Hard Rock Casino Northern Indiana (Gary, Land-based)
  • French Lick Resort Casino (French Lick, Land-based)
  • Four Winds South Bend (South Bend, Tribal)
  • Hoosier Park (Anderson, Racino)
  • Indiana Grand Casino (Shelbyville, Racino)
  • Ameristar Casino East Chicago (East Chicago, Riverboat)
  • Belterra Casino Resort & Spa (Florence, Riverboat)
  • Blue Chip Casino (Michigan City, Riverboat)
  • Hollywood Casino Lawrenceburg (Lawrenceburg, Riverboat)
  • Horseshoe Casino Hammond (Hammond, Riverboat)
  • Rising Star Casino Resort (Rising Sun, Riverboat)

Indiana Gambling Tax

In Indiana, all winnings from gambling fall under your “personal income”, which is taxed at 3.23. However, there are also federal taxes to consider, which means another 24% on top. Whether or not you are required to pay such taxes depends on your overall income.

Most land-based wagering venues will automatically deduct 25% to cover your taxes, should you win a large enough sum. If you overpay during the tax year, the IRS will refund the excess upon submitting your tax return.

How We Rank the Best Indiana Sports Betting Apps

We have explained the sites we love and what makes them unique, but we also need to show the key elements and how we rank the best Indiana online sports betting apps

sports lens rating stars

Licensing & Security

A hugely important element of our search. We look for Indiana sports betting apps with a strong license in place and take steps to ensure their service is as secure as possible. Sports betting should be enjoyable, and you will only be able to get that if you are safe and secure online, with no worries about your details and funds.

Mobile Betting Experience

We are looking at gambling apps here, so of course, this is incredibly important. We want Indiana mobile sports betting services that have a great range of markets to bet on, but at the same time, we want to see them as being easy to navigate and user friendly. A lot of time and money is spent creating apps, and we want to see great results.

Betting Markets & Odds

The markets on offer will determine what choice you have with your bets, and the odds will determine how much you win, so of course, these are both very important. We want to see good betting lines and markets for you to use, and the odds need to be competitive and some of the best on the market so that you are not missing out on additional winnings by taking low odds.

Mobile Betting Bonuses

Claiming a betting bonus is something everyone should look to do, and you can do this on your mobile. We look for Indiana mobile betting services that offer you the chance to claim regular offers - these should be for new customers and existing sportsbook customers.

Live Betting & Streaming On Mobile

The rise of live betting has made this incredibly important to several people. We want sports betting apps in Indiana to offer players the chance to access this live betting, so they can bet on the go while games are taking place. On top of this, streaming is available on many sites, and we also want to see this available on the app so that anyone can watch.

Payment Methods

Finding ways to get funds in and out of your account is incredibly important. Therefore, we want Indiana sports betting apps to offer multiple payment methods, hoping that everyone can find something they have used before or know and trust and are happy to use it to fund their account.

Customer Support

The customer support team should be on hand to help you out if needed. We look for services that have long opening hours and are contactable by many different methods, with live chat being the most essential to use because it is the most convenient.

Indiana Betting Apps for iPhone & Android

Most people own either an Android or iPhone device that they will be using to access their betting. The good news is that mobile users can access apps created for iPhone and Android users.

This will allow you to play on the specifically designed app for your device. This means higher quality service, as your software will work perfectly and run as fast as possible.

Indiana Betting Apps for Tablets

Alongside playing on a mobile device, you can access your app store and download an app for mobile betting in Indiana on your tablet device if you have one. These are portable, like a phone, but are bigger, so you cannot carry one around in your pocket.

However, if you can place bets on one, the significant advantage is that they have a far bigger screen, which will enable you to see a lot more of the service at one time. With live betting and streaming, this is even more important, as if you are watching the action, you will be able to do so on a bigger screen than your phone.
