Wagering on horse racing is not classed as sports betting in Indiana and was legalized long before the 2019 law came to pass. In fact, it has been legal to bet on the sport of kings in Indiana since 1989.

There are two live horse racing tracks located in IN. Harrah’s Hoosier Park opened its doors in 1994, while in 2009, Horseshie Indianapolis followed suit. Both have since become what are known as “Racinos” having been granted permission to offer slot machines back in 2008 and 2009, respectively.

Although Indiana sports betting legislation is a relatively recent thing, it is just a small part of a bigger gambling picture. Let’s take a look at the history of Indiana online gambling legislation.

  • 1851 – The Indiana Constitution mentions a ban on lotteries, which is interpreted as a blanket ban on all games of chance
  • 1988 – After 137 years, the lottery ban is finally lifted, leading to the creation of the Hoosier Lottery 
  • 1992 – The US Congress passes the Professional and Amateur Sports Protection Act (PASPA), which prevents individual states from legalizing sports betting
  • 2016 – A Senate bill declares Daily Fantasy Sports to be games of skill rather than chance
  • 2017 – Licenses to run DFS are awarded to four operators 
  • 2018 – The PASPA is repealed, with the Supreme Court declaring that it conflicted with the Tenth Amendment 
  • 14 May 2018 – The Murphy v. NCAA decision by the Supreme Court established state autonomy in terms of sportsbook gambling legality, free from federal intervention.
  • 2019 – On May 8, Indiana becomes the 14th US State to legalize sports betting after Gov Eric Holcomb signed HB 1015 into law.
  • 2019 – Just four months later, on September 1, the first retail sportsbook commences operations
  • 2019 – The first mobile sports betting app gets up and running the following month on October 3
  • 2020 – Notable brands like PointsBet, BetMGM, and Caesars become available in Indiana

Offshore Online Sports Betting in Indiana

The recent legislation around bookmakers in Indiana states that, for a sportsbook to be able to operate online, it must be affiliated with a land-based site. At the moment, there is nothing written into Indiana state law that says it is illegal to bet with such sites. They fall into something of a grey area. We are not aware of any individual having ever been prosecuted for playing at international casinos or sports betting sites.

Indiana Daily Fantasy Sports

Mike Pence, then Governor of Indiana, pushed legislation through in 2016 that clarified Daily Fantasy Sports as a game of skill rather than luck. As a result, there was no longer a reason for DFS to be banned. So just a year later, DraftKings and a couple of other betting platforms were given licenses to operate fantasy games.

Indiana Casino Laws

With the lifting of the state-wide lottery ban in 1988, the development of casino gaming legislation was inevitable. After several years of trying to push bills through the Senate, in 1993, a compromise was reached. Licenses were awarded for as many as 11 riverboat casinos.

In 2007, legislation was passed allowing the two racetracks to install slot machines. Then in 2015, the law was further amended to allow the riverboats to move into land-based premises due to competition in nearby states. Finally, in January 2018, the state’s only Native American tribal casino, Four Winds South Bend, opened its doors.

Online Casinos

At the time of writing, there is no law addressing the use of online casinos. Although land-based and riverboat gaming is legal, there is nothing explicitly legalizing internet casino sites.
