Is Sports Betting Legal in Kentucky?

As of March 2023, Sportsbooks are now legal in the Bluegrass State, meaning KY bettors have access to a wealth of Kentucky sports betting options, including native apps and offshore platforms.

However, this changed on the 31st of March 2023, when House Bill 551 passed through the House with a majority vote of 25-12. What’s Happening in Kentucky Sports Betting Right Now

With the signing into law of House Bill 551, Kentucky has joined the list of states where residents can place bets on sporting events other than horse racing. This allows for online and retail betting, which will come into effect in late June 2023.

  • September 28, 2023 – Legal sports betting goes live in the state of Kentucky.
  • March 9, 2023 — Sports betting legislation HB 551 was advanced by the Kentucky House Licensing, Occupations, and Administrative Regulations Committee, giving regulators in Kentucky until the end of March to get their measure through both houses.
  • March 14, 2023 — The Kentucky HB 551 sports betting measure was passed in the House and went to the Senate. A similar bill that was introduced last year was not approved by the Senate.
  • March 16, 2023 — After being advanced by the Kentucky Senate Licensing and Occupations Committee, Kentucky sports betting bill HB 551 was deemed ready to be voted on on the Senate floor.
  • March 30, 2023 — Prior to the Kentucky Derby on May 6, DraftKings debuted their horse racing app, DK Horse, in the state of Kentucky. The app first debuted in 12 states, with additional states to come.
  • March 31, 2023 — With a vote of 25–12, House Bill 551 is approved by the Senate, officially legalizing sports betting in Kentucky. The bill was subsequently signed into law by Governor Andy Beshear.
  • March 3, 2023 —Rep. Michael Meredith of Kentucky is “cautiously optimistic” that his sports betting measure, HB 551, will pass when the House Licensing, Occupations & Administrative Regulations Committee reconvenes to hear the bill.

Timeline of Kentucky Sports Betting Legislation 

Gambling has, for the most part, been illegal in the state of Kentucky ever since the creation of its constitution in 1792. Early lawmakers wanted to avoid the replication of corrupt lotteries observed in other states. 

More recently, we saw Governor Andy Beshear in Kentucky making a push to vote for sports betting in 2020. But sadly, despite public support from the Senate, it didn’t quite make it to the finish line. Here’s a historical timeline of events.

  • January 6, 2022: HB106, which is a sports betting bill is introduced. The bill includes 26 amendments that would legalize sports betting and daily fantasy sports.
  • November 2, 2022: Churchill Downs Incorporated, one of Kentucky’s major horse racing operations, acquires Peninsula Pacific Entertainment LLC.
  • April 13, 2022:The Kentucky legislature is scheduled to vote on legislation to legalize sports betting, HB 606.
  • March 29, 2022: The majority leader of the Senate, Damon Thayer, believes the bill HB 606 has a long shot at passing.
  • March 17, 2022:House Bill 606, which would legalize sports betting, passed through the Kentucky House of Representatives Licensing Committee despite significant opposition.
  • Feb. 28, 2022: HB 606, sponsored by Rep. Adam Koenig, unveils a bill regulating Kentucky sports betting. With this bill, online and retail sports betting, daily fantasy sports, and online poker are sanctioned.
  • Feb. 23, 2022: In addition to legalizing online poker and retail sports betting, Sen. David Yates introduces Bill SB 213, in the state legislature.
  • Apr. 8th, 2021: In a second attempt to push the bill through, it falls short due to the additional priorities brought into the house by COVID, delaying any decision until 2022.
  • Jan. 9, 2021: The House of Representatives receives House Bill 241. Sports betting, online poker, and daily fantasy sports are among the things that HB 241 aims to make legal in the state.
  • 2020 – A well-supported Kentucky sports betting bill drafted by Adam Koenig misses out. Proposals to issue seven betting licenses were discarded as the focus shifted to Coronavirus-related topics.
  • 14 May 2018 – The Murphy v. NCAA decision by the Supreme Court established state autonomy in terms of sportsbook gambling legality, free from federal intervention.
  • 2011 – Historical Horse Racing machines are introduced in KY. Players can bet on archived racing footage similar to a slot machine, taking advantage of legal betting loopholes.
  • 1875 – Churchill Downs opens, allowing the public to bet on horse racing.
  • 1792 – The Kentucky Constitution is written, which bans all forms of gambling except for pari-mutuel horse and greyhound betting.

Offshore Online Sports Betting in Kentucky

Although sports betting in Kentucky is now legal and live, it is also possible to make use of international brands. At the start of 2023, HB106 was introduced, which once again sought to legalize sports wagering in the state, but the eventual Bill that passed through the House was HB 551.

Kentucky Casino Laws 

There have been many attempts to bring casino gaming to Kentucky, though they have almost always failed to get through the Senate.

Most bills have proposed tying casino games to licenses at horse racing venues. This has led to the creation of several “racinos,” where slots are permitted at the racetrack. But we are unlikely to see the development of traditional casinos in Kentucky any time soon.

Online Casinos

There are no legally permitted online casinos operating in the state of Kentucky. Several attempts to legalize casino gaming have all been focused on land-based activities. Although every bill has failed to acquire Senate approval, even if they had, the online casino situation would still be unclear. It seems likely that a legal grey area would exist in which offshore casinos would be able to operate. 

Land Based Casinos

Kentucky’s racetracks are allowed to offer slot games and HHR machines. But classic table games like blackjack, roulette, or craps are not permitted at these “racinos.” There are also venues that run racing simulcasts and also offer slots gaming. This is as close to a casino as Kentucky has to offer.

KY sports betting bills

HB 551 permits the granting of sports betting licenses to the Kentucky Speedway and the nine horse racing facilities in the state, with a maximum of three online skins per venue. All of those places, as well as authorized websites and applications, will allow bettors to place their wagers.

According to regulations, the market must be operational within six months of the law’s implementation date of June 28, 2023.

Who Can Bet on Sports in Kentucky?

Betting on sports in Kentucky is now legal, and the legal age to place a wager in the state is 18 years old, which is the same for betting on horse races and playing the state lottery.

Legal age – Those who are at least 18 years old will be able to place bets on sports legally.
