Is Sports Betting Legal in Kentucky?

As of March 2023, sportsbooks are now legal in the Bluegrass State, meaning KY bettors have access to a wealth of Kentucky sports betting options, including native apps and offshore platforms.

In the last few years, there have been many attempts to legalize sports betting in what is traditionally a deeply conservative state with a strongly anti-gambling sentiment among the local governing bodies. However, this changed on the 31st of March 2023, when HB 551 passed through the House with a majority vote of 25-12. Thereafter, native sportsbooks didn’t immediately arrive in the state but finally went live on September 28, 2023.

Online Sportsbooks

As we’ve previously established, Kentucky sports betting has been legal both online and in a retail environment since March of 2023, meaning KY players can wager using many of America’s most popular sportsbooks.

It is also still possible to place bets using offshore platforms, which is perfect if you are looking for sports and casino games in one place (online casino gaming remains illegal in Kentucky). These offshore platforms operate in something of a grey area in that since they are located outside of the US, they cannot be held to local laws.

Land-based Betting

There are no physical sportsbooks in the state. The only legal form of land-based betting in Kentucky is horse racing, which takes place at several racecourses across the state.

Kentucky Horse Racing & Off Track Betting

Churchill Downs is the most well-known race track and home of the world-famous Kentucky Derby. Wagering on horse races is allowed at the course, but it is pari-mutuel, or pools betting, rather than fixed odds. The world-famous venue has also played host to the international Breeders Cup meeting, which tours around the US every year.

The Kentucky Derby is a big deal, serving as the final leg in US racing’s Triple Crown. With a $3 million purse up for grabs, the race understandably attracts attention from the international media. A guide to betting on the Kentucky Derby is even published on Yahoo Sports.

Away from Churchill Downs, horse racing takes place regularly across the Bluegrass State. There are several other tracks, such as Turfway Park, Kentucky Downs, and Red Mile, which operates harness racing.

Sports Betting Guides by State

What’s Happening in Kentucky Sports Betting Right Now

With the signing into law of House Bill 551, Kentucky has joined the list of states where residents can place bets on sporting events other than horse racing. This allows for online and retail betting, which will be effective in late June 2023.

  • September 28, 2023 – Legal sports betting goes live in the state of Kentucky.
  • March 9, 2023 — Sports betting legislation HB 551 was advanced by the Kentucky House Licensing, Occupations, and Administrative Regulations Committee, giving regulators in Kentucky until the end of March to get their measure through both houses.
  • March 14, 2023 — The Kentucky HB 551 sports betting measure was passed in the House and sent to the Senate. A similar bill introduced last year was not approved by the Senate.
  • March 16, 2023 — After being advanced by the Kentucky Senate Licensing and Occupations Committee, Kentucky sports betting bill HB 551 was deemed ready for a vote on the Senate floor.
  • March 30, 2023 — Prior to the Kentucky Derby on May 6, DraftKings debuted their horse racing app, DK Horse, in the state of Kentucky. The app first debuted in 12 states, with additional states to come.
  • March 31, 2023 — With a vote of 25–12, House Bill 551 is approved by the Senate, officially legalizing sports betting in Kentucky. The bill was subsequently signed into law by Governor Andy Beshear.
  • March 3, 2023 — Rep. Michael Meredith of Kentucky is “cautiously optimistic” that his sports betting measure, HB 551, will pass when the House Licensing, Occupations & Administrative Regulations Committee reconvenes to hear it.

Timeline of Kentucky Sports Betting Legislation

Gambling has been illegal in Kentucky since the creation of its constitution in 1792. Early lawmakers wanted to avoid the replication of corrupt lotteries observed in other states.

More recently, we saw Governor Andy Beshear in Kentucky making a push to vote for sports betting in 2020. But sadly, despite public support from the Senate, it didn’t quite reach the finish line. Here’s a historical timeline of events.

  • January 6, 2022: HB106, a sports betting bill, is introduced. The bill includes 26 amendments to legalize sports betting and daily fantasy sports.
  • November 2, 2022: Churchill Downs Incorporated, one of Kentucky’s major horse racing operations, acquires Peninsula Pacific Entertainment LLC.
  • April 13, 2022:The Kentucky legislature is scheduled to vote on legislation to legalize sports betting, HB 606.
  • March 29, 2022: The Senate majority leader, Damon Thayer, believes HB 606 has a good chance of passing.
  • March 17, 2022:House Bill 606, which would legalize sports betting, passed through the Kentucky House of Representatives Licensing Committee despite significant opposition.
  • Feb. 28, 2022: HB 606, sponsored by Rep. Adam Koenig, unveils a bill regulating Kentucky sports betting. With this bill, online and retail sports betting, daily fantasy sports, and online poker are sanctioned.
  • Feb. 23, 2022: In addition to legalizing online poker and retail sports betting, Sen. David Yates introduces Bill SB 213 in the state legislature.
  • Apr. 8th, 2021: In a second attempt to push the bill through, it falls short due to the additional priorities brought into the house by COVID, delaying any decision until 2022.
  • Jan. 9, 2021: The House of Representatives receives House Bill 241. HB 241 aims to legalize sports betting, online poker, and daily fantasy sports in the state.
  • 2020: A well-supported Kentucky sports betting bill drafted by Adam Koenig misses out. Proposals to issue seven betting licenses were discarded as the focus shifted to Coronavirus-related topics.
  • 14 May 2018: The Murphy v. NCAA decision by the Supreme Court established state autonomy in terms of sportsbook gambling legality, free from federal intervention.
  • 2011: Historical Horse Racing machines are introduced in KY. Players can bet on archived racing footage similar to a slot machine, taking advantage of legal betting loopholes.

Offshore Online Sports Betting in Kentucky

Although sports betting in Kentucky is now legal and live, it is also possible to use international brands. As we alluded to earlier in this guide to Kentucky sports betting, there are many bookies based outside of the US. Many of these offshore betting sites accept US players and provide casino games.

Since these companies have nothing to do with Kentucky or its laws, the authorities cannot penalize bettors for using their services. As a result, many KY residents take advantage of the legal loophole to place their wagers on platforms that offer both sports and casino betting.

Kentucky Daily Fantasy Sports

The laws around online gambling in Kentucky state that games of skill are allowed. For the time being, at least, this is the basis on which Daily Fantasy Sports games are permitted in the Bluegrass State.

DraftKings and FanDuel are very much the leading players in this sphere. Both DFS giants operate in KY alongside brands like Monkey Knife Fight and Yahoo Sports.

Kentucky Sports Betting Bills

There were multiple bills under consideration in 2022 that would have brought legal sports betting to the state of Kentucky. The only one to clear the chamber was HB606, but three more were put forward.

At the start of 2023, HB106 was introduced, which once again sought to legalize sports wagering in the state, but the eventual Bill that passed through the House was HB 551.

Kentucky Casino Laws

There have been many attempts to bring casino gaming to Kentucky, though they have almost always failed to get through the Senate.

Most bills have proposed tying casino games to licenses at horse racing venues. This has led to the creation of several “racinos,” where slots are permitted at the racetrack. But we are unlikely to see the development of traditional casinos in Kentucky any time soon.

Online Casinos

There are no legally permitted online casinos operating in the state of Kentucky. Several attempts to legalize casino gaming have all been focused on land-based activities. Although every bill has failed to acquire Senate approval, even if they had, the online casino situation would still be unclear. It seems likely that a legal grey area would exist in which offshore casinos would be able to operate.

Land Based Casinos

Kentucky’s racetracks are allowed to offer slot games and HHR machines. But classic table games like blackjack, roulette, or craps are not permitted at these “racinos.” There are also venues that run racing simulcasts and also offer slots gaming. This is as close to a casino as Kentucky has to offer.

The following is a list of racino venues in Kentucky:

  • Churchill Downs
  • Ellis Park
  • Keeneland
  • Kentucky Downs
  • Newport Racing and Gaming
  • Red Mile
  • Turfway Park

KY sports betting bills

HB 551 permits the granting of sports betting licenses to the Kentucky Speedway and the nine-horse racing facilities in the state, with a maximum of three online skins per venue. All of those places, as well as authorized websites and applications, will allow bettors to place their wagers.

According to regulations, the market must be operational within six months of the law’s implementation date of June 28, 2023.

Who Can Bet on Sports in Kentucky?

Betting on sports in Kentucky is now legal. The legal age to place a wager in the state is 18, the same as for betting on horse races and playing the state lottery.

  • Legal age – Those who are at least 18 years old can legally place bets on sports.
  • Mobile bettingNine racetracks in Kentucky will soon collaborate with up to 27 sports betting companies to allow mobile betting. The Kentucky Horse Racing Commission governs and regulates every betting transaction.
  • Remote registration – Remote registration is employed in the state now that online sports betting is operational. As a result, gamblers can sign up, fund their accounts, and confirm their bets with Kentucky-based sportsbooks from anywhere in Kentucky.
  • Within state borders – Only inside the boundaries of the state of Kentucky is online sports betting offered. Sportsbook operators still need to verify the whereabouts and identities of their customers using geolocation and age verification technologies.
  • Retail sportsbooks – Because Kentucky does not have any casinos, the state’s nine racetracks will be the locations for the sportsbooks that will be offered.
  • Taxable winnings – Winnings from gambling in Kentucky are subject to a tax withholding rate of 6%, which is the state’s standard rate. In addition, prizes that are greater than $5,000 are subject to an additional federal tax of 25%.

Kentucky Gambling Tax

Gambling winnings in the state of Kentucky are taxed at a flat rate of 5%. To determine your tax, subtract the stake from the total returns and take 5% of that value. This does not apply to winnings of less than $5,000.

According to the Kentucky Department of Revenue, winnings from bingo, slot machines, and keno are not generally subject to withholding tax. Further, it’s worth noting that since 2019, you have been permitted to deduct gambling losses when filing your tax return.

Most Popular Sports to Bet in Kentucky

Without a doubt, basketball is the most well-liked sport in the Bluegrass State. But basketball isn’t the only sport that’s popular in Kentucky. Let’s take a look at some of Kentucky’s other favorite betting sports.

  • BasketballThe University of Kentucky Wildcats basketball team is one of the most successful collegiate basketball programs in the country, and the state of Kentucky itself has a long and storied history of basketball. Basketball is a huge deal in Kentucky, and not only at the collegiate level but basketball at the high school level is also very popular. Basketball is the most streamed sport in Kentucky, while football is the second most streamed sport in the state, according to national statistics on sports streaming.
  • Football – There is a strong fan base for NFL football in Kentucky despite the lack of a local franchise. The Cincinnati Bengals have a lot of fans in Kentucky, and many of them travel to games to cheer on the team. Both the University of Kentucky Wildcats and the Western Kentucky University Hilltoppers play college football in the state, and there are numerous high school teams as well.
  • Baseball – As one of the most popular sports in the state, baseball in Kentucky can trace its roots back to the 19th century and can boost many notable players, including Jim Bunning and Pee Wee Reese. The state of Kentucky is home to various minor-league baseball clubs, such as the Louisville Bats and the Lexington Legends.
  • Horse racing – Considered to be an excellent place to raise horses, it seems natural that this horse-loving state has taken to horse racing betting. The Kentucky Derby, one of the world’s most famous horse racing events, has been held in Louisville for almost 140 years. The event is held in May, and bets have totaled over $230 million dollars in the past.

Kentucky Teams to Bet on

There is no shortage of teams representing the state that players can bet on. Here we will take a closer look at some of the more popular teams to bet on.

Kentucky is a major center for collegiate basketball, competing in the NCAA championship. Both the Kentucky Wildcats and the Louisville Cardinals regularly field strong teams, making for intriguing wagering scenarios.

  • Kentucky Wildcats – Kentucky has the best winning percentage (.765) and is in second place for most victories in NCAA Division I basketball history. John Calipari is the current head coach of the Kentucky Wildcats.
  • Louisville Cardinals – The Cardinals have been among the strongest teams in their league for many years, and as a result, they have made many trips to the NCAA tournament.

Much like Basketball, football is a competitive sport at the college level in Kentucky. Teams compete in the NCAA and Eastern Division of the Southeastern Conference competitions.

  • Kentucky Wildcats – The Wildcats have a 12-9 record in bowl games and a 638-635-44 overall record. They have won four consecutive bowl games after the 2018 Citrus Bowl victory, and they have one National Championship to their name (1950). Mark Stoops, their coach, is in charge.
  • Louisville Cardinals – The 2022 Louisville Cardinals football team competed in Division I FBS for the University of Louisville that year. It was Scott Satterfield’s fourth year leading the squad. In 2021, the team finished tied for 4th in their division.

Kentucky does not have a Major League Baseball franchise. The Cincinnati Reds of Ohio would be the nearest Major League Baseball team. However, it does have 8 teams representing it in the NCAA.

  • Kentucky Wildcats – The 2022 Kentucky Wildcats baseball team competed in Division I baseball for the University of Kentucky. Home games for the Wildcats are held at Kentucky Proud Park. The Wildcats had a final record of 29–23, and they were 12–18 in the Southeastern Conference.
  • Louisville Cardinals – The Cardinals ranked the 5th best team by Baseball America in the 2023 Preseason College Top 25. Combined with their previous preseason No. 6 ranking from Collegiate Baseball Newspaper, they are a formidable opponent.

Regarding the best Kentucky sports betting sites, we can not fail to include BetNow.  This site is fully licensed and regulated in Curacao. They have decent coverage of all major sports and leagues, including NFL, NBA, MLB, NHL, soccer, and UFC, and a healthy offering of American college sports.

The markets on offer for all sports are great, but BetNow’s football coverage really stands out. Their live betting on the NFL is excellent, with a huge amount of prop bets, including player props and game props like quarter and halftime scores that offer great value and provide lots of opportunities to bettors. They also provide the same amount of variety on NCAA football games.

The welcome offer is a bit low compared to some of the other best Kentucky sportsbooks, but it is a 150% matched deposit. The other promotions, like contests and reloads, that can be claimed using BetNow promo codes for existing customers more than makeup for the relatively low welcome bonus.
