Is Sports Betting Legal in Indiana?
Back in May 2019, Indiana made the historic decision to legalise sports betting. And the Hoosier State wasted no time in getting things operational, either. Just four months after the decision was made, the first sportsbook was up and running. So if you’re at least 21 years of age, sports betting in IN is completely legal.
Indiana online sports betting is also allowed, but there are conditions attached for the operator. For an internet betting site to be legal, it must be affiliated with a bricks and mortar sportsbook that has a proper license. This has led to several bookmakers partnering with existing land-based casinos, for instance, to offer their services.
Land-based Betting in Indiana
Retail sports betting is available across the state at various locations, including the following sites:
- Ameristar Casino Resort
- Caesars Southern Indiana
- FanDuel at Belterra
- FanDuel at Blue Chip
- French Lick Casino Resort
- Hollywood Casino
- Harrah’s Hoosier Park
- Horseshoe Hammond Park
- Indiana Grand
- Rising Star Casino Resort
- William Hill
- Winner’s Circle Indianapolis
- Winner’s Circle Clarksville
- Winner’s Circle New Haven
Indiana Horse Racing & Off Track Betting
Wagering on horse racing is not classed as sports betting in Indiana, and was legalised long before the 2019 law came to pass. In fact, it’s been legal to bet on the sport of kings in Indiana since 1989.
There are two horse racing tracks located in IN. Hoosier Park opened its doors in 1994, while in 2002, Indiana Downs at Shelbyville followed suit. Both have since become what are known as “Racinos”, when they were granted permission to offer slot machines back in 2008 and 2009 respectively.
There are many off track betting locations distributed throughout the state too. Winner’s Circle, owned by Caesars Entertainment, operates a number of sports bars and racing betting facilities across Indiana.
Timeline of Indiana Sports Betting Legislation
Although Indiana sports betting legislation is a relatively recent thing, it is just a small part of a bigger gambling picture. Let’s take a look at the history of Indiana online gambling legislation.
- 1851 – The Indiana Constitution mentions a ban on lotteries, which is interpreted as a blanket ban on all games of chance
- 1988 – After 137 years, the lottery ban is finally lifted, leading to the creation of the Hoosier Lottery
- 1992 – The US Congress passes the Professional and Amateur Sports Protection Act (PASPA) which prevents individual states from legalizing sports betting
- 2016 – A Senate bill declares Daily Fantasy Sports to be games of skill, rather than chance
- 2017 – Licenses to run DFS are awarded to four operators
- 2018 – The PASPA is repealed, with the Supreme Court declaring that it conflicted with the Tenth Amendment
- 2019 – On May 8, Indiana becomes the 14th US State to legalize sports betting
- 2019 – Just four months later on September 1, the first sportsbook commences operations
- 2019 – The first mobile sports betting app gets up and running the following month on October 3
The recent legislation around bookmakers in Indiana states that, for a sportsbook to be able to operate online, it must be affiliated with a land-based site. However, players can freely access many online betting sites which are based abroad and are not actively touting for business in the US. So how are these offshore betting companies handled locally?
At the moment, there is nothing written into Indiana state law that says it is illegal to bet with such sites. They fall into something of a grey area. We are not aware of any individual having ever been prosecuted for playing at international casinos or sports betting sites.
Indiana Daily Fantasy Sports
Mike Pence, then Governor of Indiana, pushed legislation through in 2016 which clarified Daily Fantasy Sports as a game of skill, rather than luck. As a result, there was no longer a reason for DFS to be banned. So just a year later, DraftKings and three other firms were given licenses to operate fantasy games.
Indiana Casino Laws
With the lifting of the state-wide lottery ban in 1988, the development of casino gaming legislation was inevitable. After several years of trying to push bills through the Senate, in 1993, a compromise was reached. Licenses were awarded for as many as 11 riverboat casinos.
In 2007, legislation was passed allowing the two racetracks to install slot machines. Then in 2015, the law was further amended to allow the riverboats to move into land-based premises, due to competition in nearby states. Finally, in January 2018, the state’s only Native American tribal casino opened its doors.
At the time of writing, there is no law addressing the use of online casinos. Although land-based and riverboat gaming is legal, there is nothing explicitly legalizing internet casino sites.
However, much like with offshore online sportsbooks, there is a plethora of international casino brands accessible to players online. These exist within a legal grey area and no Indiana residents are known to have been punished for playing at such sites.
Land Based Casinos
Until fairly recently, there were no land-based Indiana casinos permitted. The law only allowed for riverboat casinos until 2007. Here is a full list of the various casinos found across IN.

Indiana Gambling Tax
In Indiana, all winnings from gambling fall under your “personal income”, which is taxed at 3.23. However, there are also federal taxes to consider, which means another 24% on top. Whether or not you are required to pay such taxes depends on your overall income.
Most land-based wagering venues will automatically deduct 25% to cover your taxes, should you win a large enough sum. If you overpay during the tax year, the IRS will refund the excess upon submitting your tax return.
