Chelsea want their Mikel money back

Chelsea have issued a High Court claim for £16m against FC Lyn Oslo and their former chief executive Morgen Andersen. This claim is related to the transfer of Jon Mikel Obi and specifically the 16m payments Chelsea made (4m to Lyn Oslo, 12m to Manchester United) in 2006 as part of a settlement.

Chelsea say the deal was based on the fraudulent misrepresentation that Mikel had an employment contract with Lyn.

Chelsea statement:

“At the time of the transfer, Chelsea, Lyn and Manchester United agreed that the fees paid would be in final settlement of the transfer, any claims related to it and that no further action or comment regarding the transfer would be made.

Chelsea has written to Lyn to make clear that because the transfer was based on a fraudulent misrepresentation, now proven by a court of law, the settlement previously agreed is not binding.

Chelsea is in contact with Lyn and looks forward to working positively with them to resolve the claim promptly.

Chelsea would like to make clear that this legal action is against Lyn and Morgan Andersen.”

Although Chelsea are right to go after Anderson, I’m not sure if Lyn are the right targets and whether they would be able to pay back the full amount. Most likely scenario is that this matter will be stuck in the courts for several months, maybe an year or two (remember the Mutu claim?) and at best I’d see Lyn returning the 4m they were paid and Anderson being under the cosh for screwing things up.

It’s certainly a lot easier going after Lyn than after United, smart of Chelsea to realise that, and although I still think they won’t get all their money back, no one would think of ‘messing’ with Chelsea again.
